Below are options you can choose, depending on your circumstances. Please place a checkmark by the trust package you would like below. All of the below options include unlimited guidance by Florida Attorney Cyrus Malhotra:
- General Revocable Trust – This is an extremely comprehensive and thorough general trust, designed to cover most any asset and situation. When people refer to having a “trust”, or “living trust”, this is what they are referring to.
- Multi-Generational (Perpetual) Trust – This special type of revocable trust allows you to pass the items through future generations of your family as they are born. This can last for up to 360 years.
- Asset Protection (Irrevocable) Trust – Some of our clients have concerns about asset protection, and would like to insulate their assets from lawsuits or divorce. In this instance, an Irrevocable Trust may be the answer. You should be aware that making future changes to an irrevocable trust is possible, but is much more difficult than with a general revocable trust, so careful thought should be given as to the structure of your trust.
- Special Needs Trust – Some of our clients have concerns about the judgement of their children, or their mental/physical limitations. In such a case, a Special Needs Trust can create the safeguards needed to ensure your inheritance is properly maintained, and your loved ones will receive the financial assistance they need.
- Land Trust (for real estate) – A Land Trust is drafted specifically for real estate holdings; it allows anonymity for land owners who do not want their name showing on public record. It also allows the landowner to designate co-trustees to help manage the property, and beneficiaries who can receive the asset at a designated time in the future, even after the Grantor (you) has passed.

Successor Trustees
Successor Trustees are much more common. Successor trustees have no current rights to your trust property, however in the event something should happen to you, the successor trustee(s) would gain possession of the items in your trust, and would carry out your wishes. It is a good idea to name at least 2 successor trustees.

If you have named more than one, do you want them serving at the same time, or in succession? If creating a Dynasty Trust, all trustees will serve concurrently automatically.

BENEFICIARIES

The beneficiary is ultimately who will receive the trust assets. It is a good idea to name alternate beneficiaries in case your main beneficiary precedes you in death. You can name minors as beneficiaries.
